2. Update DirectX
3. Install any available game patches
4. Try the game in Vista compatibility mode

I have all the latest updates for graphics card and game updates, i ran it in all compatability modes and still no result. would re-formatting my whole computer fix this or is there another way?

sometimes newer beta video drivers can fix issue such as this, or sometime new drivers knack it, also also try a few revisions earlier.
