OpenAI’s ChatGPT Search and Roblox could be designated under the European Union’s toughest Digital Services Act rules as soon as August, bringing systemic-risk audits, transparency reporting, and direct European Commission supervision to two services with large EU audiences.
Bloomberg first reported that the Commission is preparing to classify ChatGPT Search as a Very Large Online Search Engine and Roblox as a Very Large Online Platform. The Mercury News and other outlets subsequently reported the same planned move. The Commission had not formally announced either designation as of August 1.
The distinction matters. The reported action concerns ChatGPT’s web-search feature, rather than every capability in the ChatGPT client. OpenAI’s own DSA disclosure says ChatGPT Search averaged about 159.1 million monthly active recipients in the EU for the six months ending March 31, 2026—well above the 45 million threshold that triggers the regime.
Roblox would be the more unusual case: a gaming platform entering the DSA’s highest oversight tier, where child safety, illegal-content exposure, recommender systems, and other systemic risks receive more formal scrutiny.
Under the Commission’s published DSA process, a designated VLOP or VLOSE has four months to comply. That goes beyond the baseline rules that already apply to online services operating in Europe.
The added requirements include regular risk assessments and mitigation plans, annual independent audits, expanded transparency reporting, researcher and regulator data access in defined circumstances, and a supervisory fee paid to the Commission. The DSA permits penalties of up to 6% of a provider’s worldwide annual turnover for non-compliance.
For OpenAI, the immediate work would likely center on how ChatGPT Search surfaces web results, handles unlawful material notices, documents moderation decisions, and explains ranking or recommendation behavior. The designation would not automatically dictate how a Windows user runs the ChatGPT desktop app, but it could lead to EU-specific changes in disclosures, reporting tools, search controls, and content-handling workflows.
Roblox has already been tightening parental controls and age-related safeguards, but a VLOP designation would turn many of those operational decisions into matters subject to formal risk assessments, outside audit, and Commission oversight. That raises the stakes for its moderation systems, creator-content policies, in-game communications, and recommendations.
