Nowhere is this truer than at Microsoft, one of the world’s most influential software providers. Over recent months, as violence erupted and tragic news emerged from the region, employees, activists, and segments of the public have demanded to know: Was Microsoft technology leveraged to harm civilians in Gaza?
Microsoft’s May 15 statement, published as a corporate blog post, sought to address these demands head-on. The company concluded that, based on both its internal review and an external investigation conducted by an unnamed third party, it found “no evidence to date that Microsoft’s Azure and AI technologies have been used to target or harm people in the conflict in Gaza.” But has Microsoft truly undertaken a transparent examination of its role? And do such statements satisfy the concerns of employees and the wider public? This support, the blog claims, underwent “significant oversight” to avoid civilian rights violations. Importantly, however, Microsoft also stated: “Microsoft has not created or provided such software or solutions to the IMOD that would enable targeted military operations.” Yet, it added a crucial caveat: the company does not retain visibility into how its tools are used once deployed on private servers or government systems not hosted on Microsoft’s public cloud.

Analysis of the Facts​

These assertions present a classic tension in tech: the challenge of oversight in an era where software and cloud solutions, once delivered, are often deployed within opaque state-run data centers. Microsoft’s claim that it cannot “see” how its products are used in private or government facilities is not unique in the industry. Legally and technically, companies are limited in their ability—or willingness—to audit client-side use of general-purpose software.
Nevertheless, the public’s expectations often exceed these limits, especially in situations involving allegations of war crimes or potential human rights abuses. What evidence was sought, what powers of investigation were exercised, and who supplied the information?

While there is, as of publication, no public evidence directly linking specific Microsoft tools to acts of violence in Gaza, it is indisputable that the IMOD and other Israeli government entities are long-standing Microsoft customers. Azure contracts, Office 365 subscriptions, and custom development platforms are commonplace in Israeli IT procurement. Despite this, technology transfer agreements rarely reveal the downstream use of software and infrastructure, particularly after localized deployment.

Verifying Client Use: An Impossibility?​

The company’s admission—it cannot know how its tools are used once delivered—reflects an industry-wide paradox. Whether a coincidence or deliberate timing, the effect was to magnify criticism that Microsoft’s public relations strategy is disconnected from, or indifferent to, the suffering of real people.

Legally, it may be difficult—arguably impossible—for vendors to trace the use of their generic technologies in conflict zones. Ethically, however, the rules are less clear-cut. International human rights standards, now evolving to address digital technologies, increasingly urge companies to conduct “human rights impact assessments” both before and after doing business with militaries or governments credibly accused of abuses.

As public pressure mounts, Microsoft—and Big Tech at large—must answer one fundamental question: Is it enough to say it didn’t know, or does real responsibility begin with the choice of whom to serve?
