Yes, you would be breaking the Windows EULA. So yes it is illegal.

On a side note, google Peter Kleissner the poster of that "Patch" and you may not want to even attempt to install that lol. Security researcher gets root on Windows 8 with bootkit This about Peter and his Windows 8 bootkit
